Terms of use
These terms of use (“Terms”) are an agreement between you and Double AI, Inc.(“Double”, “we”, “us”), a Delaware corporation. They govern your use of trydouble.ai and any page, form or feature on it (the “Site”). Please read them carefully.
1. Accepting these terms
By accessing or using the Site, including by submitting an application or booking a call, you agree to these Terms and confirm that you have read our privacy policy. If you use the Site on behalf of a company or other organization, you agree to these Terms on its behalf and confirm that you are authorized to do so. If you do not agree, do not use the Site.
2. Eligibility
You must be at least 18 years old to use the Site. By using it, you confirm that you are 18 or older, that you are legally able to enter into these Terms, and that you are not barred from receiving services or payments under the laws of the United States or the country where you live, including because you are named on a US government sanctions list.
3. What the Site is
The Site provides general information about Double, the services we offer to robotics teams and the project work we offer to skilled professionals. It also lets experts submit applications and lets anyone book a call or contact us. Information on the Site, including descriptions of services, roles, rates, timelines and outcomes, is provided for general information only. It is not an offer, a quotation or a commitment, and we may change or remove it at any time without notice.
4. Expert applications and project work
- Your application must be accurate. The information you submit must be true, complete and your own. Do not apply on behalf of another person.
- Applying is not an offer of work. Roles and rates shown on the Site describe the kind of work we expect to offer and its typical pay. Submitting an application does not create an employment relationship, a contract for services or any obligation on either side, and it does not guarantee that you will be contacted, engaged or assigned work. We decide in our discretion whether to engage any applicant.
- Project work is governed by a separate agreement. If we engage you, the scope, time, payment, confidentiality and ownership of your work will be set out in a separate written agreement signed by you and Double. If that agreement conflicts with these Terms, the agreement controls.
- Independent contractor status. Unless your written agreement expressly states otherwise, experts are engaged as independent contractors and not as employees, agents or partners of Double. As an independent contractor, you are responsible for your own taxes and for meeting any legal requirements that apply to you where you live.
- Materials you submit. You keep ownership of your application and résumé. You give Double permission to store, copy and use them to evaluate your application and to contact you about projects, as described in our privacy policy.
5. Robotics-team services
Pilots, task creation, training data, evaluation and any other services for robotics teams are provided only under a separate written order form or agreement signed by Double and the customer. That document sets out the deliverables, fees, data formats, confidentiality, ownership and usage rights for the engagement, and controls over these Terms if they conflict. Booking a call, sending an enquiry or discussing a project does not create any obligation on either side.
6. Acceptable use
When you use the Site, you agree not to:
- provide false or misleading information, or impersonate any person or organization
- upload or send anything unlawful, defamatory, infringing or harmful, including malware, or anything you do not have the right to share
- interfere with or disrupt the Site, attempt to gain unauthorized access to it or to our systems, or probe, scan or test their vulnerability
- use bots, scrapers or other automated means to submit forms, book calls or place excessive load on the Site
- use the Site to send spam or other unsolicited messages
- copy, modify or create derivative works of the Site except as these Terms allow
- use the Site in violation of any applicable law, or help anyone else do any of these things
7. Our intellectual property
The Site and its content, including text, graphics, illustrations, designs, logos and code, are owned by Double or our licensors and are protected by copyright, trademark and other laws. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable permission to view the Site and to share links to it for your personal or internal business purposes. All other uses require our prior written permission. “Double”, the Double logo and our other marks may not be used in connection with any product or service without our prior written permission.
8. Feedback
If you send us ideas, suggestions or other feedback about the Site or our services, you grant Double a perpetual, irrevocable, worldwide, royalty-free license to use it for any purpose without restriction or payment to you. You are not required to send feedback, and we are not required to use it. This section does not apply to application materials or to work you do under a separate agreement.
9. Third-party services and links
The Site uses services provided by other companies, including a scheduling calendar from Cal.com, Inc. embedded on the booking page and FormSubmit for delivering applications, and it links to other websites such as our social media profiles. These services and websites are governed by their own terms and privacy policies. We do not control them and are not responsible for their content, availability or practices. Your use of them is at your own risk.
10. Disclaimers
THE SITE IS PROVIDED “AS IS” AND “AS AVAILABLE”. TO THE FULLEST EXTENT PERMITTED BY LAW, DOUBLE DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED OR STATUTORY, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, SECURE OR FREE OF ERRORS OR HARMFUL COMPONENTS, OR THAT ITS CONTENT IS ACCURATE, COMPLETE OR CURRENT.
11. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, DOUBLE AND ITS OFFICERS, DIRECTORS, EMPLOYEES AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA OR GOODWILL, ARISING OUT OF OR RELATING TO THE SITE OR THESE TERMS, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF THOSE DAMAGES. OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SITE OR THESE TERMS WILL NOT EXCEED ONE HUNDRED US DOLLARS (US$100).
Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain damages, so some of the limits above may not apply to you. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for fraud, gross negligence, willful misconduct, or death or personal injury caused by negligence. These limits do not apply to obligations under a separate written agreement with Double, which sets its own terms.
12. Indemnity
To the extent permitted by law, you agree to indemnify and hold harmless Double and its officers, directors, employees and agents from any claims, losses, liabilities and expenses, including reasonable legal fees, arising from your breach of these Terms, your misuse of the Site, or content you submit through it.
13. Governing law and disputes
These Terms, and any dispute arising out of or relating to them or to the Site, are governed by the laws of the State of Delaware, United States, without regard to its conflict of laws rules.
If you have a dispute with us, please first email [email protected] with a description of the issue. We will try in good faith to resolve it with you informally within 30 days. If we cannot, either of us may bring the dispute only in the state or federal courts located in the State of Delaware, and both of us consent to the personal jurisdiction of those courts. Either of us may seek an injunction or other urgent relief in any court with jurisdiction to protect intellectual property or confidential information.
If you are a consumer living in the European Union, the United Kingdom or another country whose laws give you mandatory protections, nothing in this section takes those protections away, including your right to bring proceedings in the courts where you live.
14. Suspension and termination
We may suspend or end your access to the Site, or decline to consider an application, at any time if we reasonably believe you have breached these Terms or that doing so is needed to protect the Site, Double or others. You may stop using the Site at any time. Sections 4 (materials you submit), 7, 8 and 10 through 16 continue to apply after your use of the Site ends.
15. Changes to these terms
We may update these Terms from time to time. The effective date at the top of this page shows when they last changed. If we make a material change, we will post a notice on the Site before it takes effect. Changes apply from their effective date and do not apply to disputes that arose before that date. If you continue to use the Site after a change takes effect, you accept the updated Terms.
16. General
- Entire agreement. These Terms and our privacy policy are the entire agreement between you and Double about the Site. A separate written agreement between you and Double governs the matters it covers.
- Severability. If any part of these Terms is found to be unenforceable, it will be enforced to the maximum extent permitted and the rest of the Terms will remain in full effect.
- No waiver. Our failure to enforce any part of these Terms is not a waiver of our right to enforce it later.
- Assignment. You may not transfer your rights or obligations under these Terms without our written consent. We may transfer ours, including as part of a merger, acquisition or sale of assets.
- Notices. We may give you notices by email or by posting them on the Site. You may give us notices by email to [email protected].
- Relationship. Nothing in these Terms creates a partnership, joint venture, employment or agency relationship between you and Double.
